Article 90 — Limitations and oversight during a state of exception
(1) Az Alkotmánybíróság különleges jogrend idején is teljes hatáskörében jár el.
(2) A bíróságok különleges jogrend idején is működnek.
(3) A különleges jogrend idején hozott intézkedések Alkotmánnyal való összhangját bíróság vizsgálhatja felül. A bíróság ideiglenes jogvédelmet nyújthat.
(4) Az Alkotmánybíróság a különleges jogrend kihirdetését annak közzétételétől számított öt napon belül felülvizsgálja. Vizsgálja annak indokait, szükségességét, területi hatályát, időtartamát és az alkotmányos eljárás betartását. Ugyanez a felülvizsgálat vonatkozik a meghosszabbításra és az országgyűlési megerősítésre.
(5) Az országgyűlési képviselők egyötöde, az Alapvető Jogok Biztosa vagy a Nemzeti Választási Bizottság a körülmények változásakor újabb felülvizsgálatot kezdeményezhet. Az Alkotmánybíróság öt napon belül dönt. A döntésig a kihirdetést vagy annak joghatásait felfüggesztheti.
(1) The Constitutional Court continues to exercise its full jurisdiction during a state of exception.
(2) The courts continue to function during a state of exception.
(3) Measures taken during a state of exception are subject to judicial review of their conformity with this Constitution. Courts may grant interim protection.
(4) The Constitutional Court reviews a declaration of a state of exception within five days of its publication. It examines the grounds, necessity, territorial scope, duration, and constitutional procedure. A renewal or parliamentary confirmation is subject to the same review.
(5) One-fifth of the members of the National Assembly, the Commissioner for Fundamental Rights, or the National Election Commission may request further review as circumstances change. The Court decides within five days and may suspend the declaration or its effects pending judgment.
